The healthcare industry is undergoing a seismic shift as artificial intelligence moves from the fringes into the very heart of patient care. OpenAI’s ChatGPT and Anthropic’s Claude are no longer just tools for answering trivia questions or drafting emails—they’re now positioned as your personal health advisors, capable of interpreting lab results, offering wellness tips, and even helping you navigate the labyrinth of insurance paperwork.
But beneath the glossy promises of convenience and personalization lies a troubling reality: these AI systems operate in a legal and ethical gray zone, where your most sensitive medical data could be at risk, and the advice you receive might be dangerously wrong.
The AI Healthcare Gold Rush
Every week, more than 230 million people turn to ChatGPT for health and wellness advice, according to OpenAI. That’s a staggering number—more than the entire population of Brazil seeking medical guidance from a chatbot. And it’s no surprise why: healthcare in America is broken. Long wait times, skyrocketing costs, and confusing insurance policies have left millions desperate for alternatives.
OpenAI is betting big on this frustration. In a bold move, the company launched ChatGPT Health, a dedicated tab within the app designed to handle health-related queries in what it claims is a more secure and personalized environment. Around the same time, Anthropic unveiled Claude for Healthcare, a “HIPAA-ready” product aimed at hospitals, providers, and consumers.
Even Google, the quiet giant of AI, has entered the fray with updates to its MedGemma medical AI model, though its Gemini chatbot remains conspicuously absent from the healthcare spotlight.
Your Data, Their Playground
Here’s where things get murky. OpenAI actively encourages users to share sensitive information—medical records, lab results, health app data from Apple Health, Peloton, Weight Watchers, and MyFitnessPal—in exchange for deeper insights. The company promises that your data will be kept confidential, won’t be used to train AI models, and will be encrypted by default.
But experts warn that these assurances are far from ironclad. Unlike hospitals and clinics, tech companies aren’t bound by the same strict privacy laws. While OpenAI’s consumer-facing ChatGPT Health sounds reassuring, it’s worth noting that the company launched a nearly identical product, ChatGPT for Healthcare, aimed at businesses and clinicians. This enterprise version comes with tighter security protocols and is designed to comply with healthcare privacy regulations like HIPAA.
The similarity in names and launch dates is no accident—it’s a deliberate strategy to make consumers believe they’re getting the same level of protection as enterprise clients. But they’re not. As law professor Sara Gerke from the University of Illinois Urbana-Champaign explains, “Data protection for AI tools like ChatGPT Health largely depends on what companies promise in their privacy policies and terms of use.”
And promises can change. Hannah van Kolfschooten, a digital health law researcher at the University of Basel, puts it bluntly: “You will have to trust that ChatGPT does not change its terms of use over time.”
The Danger of Trusting AI With Your Health
It’s not just about privacy—it’s about safety. Medicine is a heavily regulated field for a reason: mistakes can be deadly. Yet chatbots have already demonstrated a troubling tendency to confidently spout false or misleading health information.
Take the case of a man who developed a rare condition called bromism after ChatGPT suggested he replace salt in his diet with sodium bromide—a sedative that was historically used to treat epilepsy but is now known to be toxic in high doses. Or consider Google’s AI Overviews, which wrongly advised pancreatic cancer patients to avoid high-fat foods—the exact opposite of what they should be doing.
OpenAI acknowledges these risks, explicitly stating that ChatGPT Health is not intended for diagnosis or treatment and should be used in close collaboration with physicians. But the company’s actions tell a different story. OpenAI has gone to great lengths to prove that ChatGPT is a capable medic, even inviting a cancer patient and her husband on stage to discuss how the tool helped her make sense of her diagnosis.
The company has also developed HealthBench, a benchmark it claims tests how well AI models perform in realistic health scenarios. But critics argue that the benchmark lacks transparency and is designed to make ChatGPT look good.
The Regulatory Wild West
Here’s the kicker: because OpenAI claims ChatGPT Health is not a medical device, it escapes the scrutiny of regulators like the Food and Drug Administration (FDA). This loophole allows companies to market their products as health tools without undergoing the rigorous testing required for medical devices.
Law professor Carmel Shachar from Harvard Law School explains, “The value of HIPAA is that if you mess up, there’s enforcement. But if a company voluntarily complies and fails to do so, there’s little at stake.”
This regulatory gray area is precisely why experts like van Kolfschooten argue that tools like ChatGPT Health should be classified as medical devices and subject to stricter oversight. “It’s important to look at how it’s being used, as well as what the company is saying,” she says.
The Trust Paradox
Despite the risks, millions of people are already using AI chatbots for health advice. And why wouldn’t they? The healthcare system is broken, and AI offers a tantalizing promise of convenience and accessibility.
But trust is earned, not given. The medical profession has spent decades building trust through rigorous training, ethical standards, and accountability. Tech companies, on the other hand, have a reputation for moving fast and breaking things.
As AI continues to infiltrate healthcare, the question isn’t just whether these tools can provide accurate advice—it’s whether they can be trusted with our most sensitive data and our lives.
