The case, filed in the United States Court of International Trade, comes in the wake of a landmark Supreme Court decision last month that struck down President Donald Trump’s use of the International Emergency Economic Powers Act (IEEPA) to levy tariffs on a wide range of imported goods. The Court found that the administration had overstepped its authority by using the act—originally designed to address national security threats—to implement broad economic sanctions without congressional approval.
By the time the ruling was handed down, however, the U.S. government had already collected an estimated $10 billion in tariffs under the disputed policy. This has left companies that paid the duties in a legal and financial limbo, unsure whether they can recover the funds or if the money will simply be absorbed into federal coffers.
Nintendo’s lawsuit is particularly aggressive in its demands. In its court filing, the company cites the Supreme Court’s ruling in Learning Resources and previous decisions in V.O.S. Selections to argue for an immediate, full refund of all IEEPA-related tariffs it paid, regardless of whether those payments have been officially “liquidated” (a term referring to the finalization of customs duties). The filing also requests interest on the refunded amounts and any other remedies the court deems appropriate.
The defendants named in the case read like a who’s who of the U.S. trade and security apparatus. They include the Department of Homeland Security and former Secretary Kirstjen Nielsen (who was recently dismissed from her post); the Office of the United States Trade Representative and its head, Jamieson Greer; U.S. Customs and Border Protection and its commissioner, Rodney Scott; and the Department of Commerce and its secretary, Howard Lutnick.
This legal action is not occurring in a vacuum. Several other companies have already filed similar lawsuits, signaling a potential wave of litigation that could force the government to return billions in tariff revenue. The outcome of these cases could have far-reaching implications for how trade policy is enforced in the U.S. and whether executive agencies can unilaterally impose economic penalties without legislative backing.
For Nintendo, the stakes are both financial and symbolic. As a company that relies heavily on global supply chains—particularly for its hardware, which is largely manufactured in China—the tariffs represented a significant cost burden. Recovering those funds could provide a substantial boost to its bottom line, but the lawsuit also positions Nintendo as a defender of corporate rights against what it sees as overreach by the executive branch.
